Terms of Service

These Terms of Service ("Terms") govern your use of the social media publishing service operated by Made by Felipe ("we", "us"), available at social.madebyfelipe.agency (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. What the Service does
The Service lets you compose, schedule and publish content to social media accounts that you connect to it. It acts on your instruction and on your behalf. It does not create content autonomously, and it does not act on your connected accounts beyond what you configure.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a contract. If you use the Service on behalf of a company or client, you confirm that you are authorised to do so and to accept these Terms for that organisation.
3. Your account
- You are responsible for keeping your credentials confidential.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly at byonichip@gmail.com if you suspect unauthorised access.
- You must provide accurate information and keep it up to date.
4. Connected social media accounts
To publish content, you connect third-party accounts through their official authorisation flows. By doing so you confirm that:
- You own those accounts, or have explicit permission from their owner to publish on them.
- You will comply with the terms, policies and community guidelines of each platform.
- You understand that each platform independently controls whether a publication succeeds, and may restrict, reject or remove content according to its own rules.
You may disconnect any account at any time, both inside the Service and from the platform's own settings.
5. Your content
You retain full ownership of everything you create, upload or publish through the Service. You grant us a limited, non-exclusive licence to store, process and transmit that content solely for the purpose of operating the Service and delivering your content to the platforms you selected. This licence ends when you delete the content or close your account.
6. Acceptable use
You agree not to use the Service to:
- Publish content that is unlawful, defamatory, harassing, hateful, or that infringes anyone's intellectual property or privacy rights.
- Distribute malware, phishing links, or deliberately misleading information.
- Send unsolicited bulk or automated content in violation of any platform's rules on spam.
- Attempt to circumvent rate limits, authentication, or any technical restriction of the Service or of a connected platform.
- Access or attempt to access accounts, data or systems that do not belong to you.
- Resell or redistribute access to the Service without our written agreement.
7. Third-party platforms
The Service depends on APIs provided by third parties. Those platforms may change, restrict or discontinue their APIs at any time, without notice to us. We are not responsible for:
- Failures, delays or rejections caused by a platform's API.
- Changes to a platform's terms, permissions or approval requirements.
- Suspension or termination of your accounts by a platform.
Your relationship with each platform is governed by that platform's own terms, not by these Terms.
8. Availability
We aim to keep the Service running continuously, but we do not guarantee uninterrupted availability. The Service may be unavailable during maintenance, updates, or events outside our control. Scheduled publications may fail as a result, and you remain responsible for verifying that important content was published.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, data, business opportunities or goodwill, arising out of or related to your use of the Service.
Nothing in these Terms excludes liability that cannot be excluded under Brazilian law, including liability for wilful misconduct.
11. Indemnity
You agree to hold us harmless from any claim, demand or expense arising from content you publish through the Service, from your breach of these Terms, or from your violation of any third-party right or platform policy.
12. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if your use puts the Service or other users at risk. On termination, your data is deleted as described in our Privacy Policy.
13. Changes to these Terms
We may revise these Terms as the Service evolves. The date at the top of this page reflects the current version. Continued use after a change constitutes acceptance. Material changes will be communicated to account holders by email.
14. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute will be submitted to the courts of the domicile of Made by Felipe, unless applicable consumer protection law provides otherwise.
